Binding consumer arbitration is a major impediment for consumer’s seeking to enforce their rights and to advocates who are seeking to protect marketplace integrity. Arbitration is not a suitable alternative to traditional litigation, nor is it necessarily cheaper. Perhaps most damaging is it occurs behind closed doors with almost no right to appeal. There is no record, no opportunity for public scrutiny, and legal precedent established. The National Association of Consumer Advocates has established an information page on this important issue.
